PHOENIX (AP) -- The state Game and Fish Commission on Monday moved to satisfy a court order by unanimously authorizing nearly 800 additional elk and deer permits for this fall's hunt.

U.S. District Judge Robert Broomfield had declared the state's10 percent cap on the number of permits that go to non-Arizona hunters an unconstitutional infringement on interstate commerce. The judge also prohibited the state from using the cap.

The state on Friday asked the judge to put his order on hold because the issuance of permits for the fall hunt is about to begin, but he refused Monday.

The commission reacted by approving 127 additional deer permits for areas north of the Colorado River and 678 additional elk permits statewide.

Game and Fish Department officials said nearly all of the additional permits will go to out-of-state residents through a supplemental random draw from applications already filed for permits.

The increase is to satisfy the court order for just this year and the state will embark on what is expected to be a lengthy process of crafting a permanent response, officials said.

Many of the approximately 200 hunters attending Monday's meeting applauded the commission action, with some saying during or after the meeting that the step taken was reasonable under the circumstances.
